Gym Membership Terms & Conditions
1. Membership Agreement
By signing up to a membership online you are signing this Membership Agreement, acknowledging that you have read, understood, and agree to be bound by these Terms and Conditions. Membership is personal, non-transferable, and cannot be shared with another individual.
2. Membership Eligibility
- Members must be at least 16 years of age.
- Members under 18 years of age may require written consent from a parent or legal guardian.
- The Gym reserves the right to refuse or terminate membership where deemed appropriate.
3. Membership Contracts
- Memberships are subject to the agreed contract term as outlined in the Membership Agreement.
- Members are responsible for all payments throughout the contract period.
- Memberships will continue on a ‘rolling’ basis once the contracted term has been completed and won’t be cancelled automatically unless requested otherwise.
- Membership fees are payable regardless of attendance.
- Early termination is only permitted under the circumstances outlined in these Terms and Conditions.
4. Membership Payments
- Membership fees are collected via the agreed payment method.
- Payments must be made on time.
- Failed or missed payments may incur administration charges.
- Access to the Gym will be suspended until outstanding balances are cleared.
- Continued non-payment may result in debt recovery proceedings, with reasonable recovery costs added where legally permitted.
5. Cooling-Off Period
Where required by applicable law, members may cancel within the statutory cooling-off period. Any refunds will be processed in accordance with applicable consumer legislation.
6. Membership Cancellation
Members may cancel before the end of their contract only in the following circumstances:
- Serious medical condition preventing exercise (supported by medical evidence).
- Permanent relocation beyond a reasonable travelling distance (proof required).
- Other exceptional circumstances at the Gym’s sole discretion.
Notice of cancellation must be provided in writing together with any supporting documentation.
7. Membership Freeze
Memberships may be frozen for approved reasons such as:
- Medical treatment or injury.
- Pregnancy.
- Extended travel.
- Military deployment or other exceptional circumstances.
A minimum and maximum freeze period may apply, and contract end dates may be extended accordingly.
8. Access to the Gym
- Members must use their own access credentials.
- Tailgating or allowing non-members to enter is strictly prohibited & can result in membership termination with no refund.
- The Gym reserves the right to refuse entry where necessary.
9. Health Declaration & ParQ (Health Questionnaire)
Members confirm that:
- They are physically able to participate in exercise.
- They have disclosed any medical conditions that may affect safe participation.
- They understand that exercise carries inherent risks.
Members are encouraged to seek medical advice before commencing an exercise programme.
You warrant, declare and acknowledge that:
- The information given by you in entering this agreement is correct and will be relied upon by us.
- To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, well being or physical condition. Further, that you will advise us immediately should your health or vulnerability to injury change.
- You have read and understood this agreement and all of its the Terms and Conditions before accepting them above.
- This agreement will become binding upon both parties once you have checked the “I agree to the T’s & C’s and Health Questionnaire” box and confirmed payment.
10. Member Conduct
Members are expected to:
- Treat staff and fellow members with courtesy and respect.
- Follow all instructions given by Gym staff.
- Behave in a manner that promotes a safe and welcoming environment.
- Refrain from abusive, threatening, discriminatory, or intimidating behaviour.
- Avoid excessive noise, shouting, or disruptive conduct.
- Respect the privacy of other members.
The Gym operates a zero-tolerance policy towards harassment, bullying, discrimination, violence, or aggressive behaviour.
11. Gym Etiquette
Members agree to:
- Return all equipment after use.
- Wipe down equipment after each use using the cleaning materials provided.
- Re-rack all weights after use.
- Avoid dropping weights unnecessarily.
- Wear appropriate clean training clothing and enclosed footwear at ALL times - no tops off!
- Use towels where appropriate.
- Limit time on equipment during busy periods.
- Allow others to work in where practical.
- Keep walkways clear.
- Dispose of rubbish responsibly.
- Report damaged equipment immediately.
12. Equipment Use
- Equipment must only be used as intended.
- Members should seek instruction if unsure how to operate equipment.
- Damaging equipment intentionally or through misuse may result in repair or replacement costs.
13. Personal Training
Only personal trainers authorised by the Gym may provide coaching or instruction on the premises.
Unauthorised personal training or commercial activity is prohibited.
14. Photography & Video Recording
Photography or video recording is only permitted where it does not infringe the privacy of other members.
The Gym reserves the right to prohibit recording at any time.
Commercial filming requires prior written approval.
15. Mobile Phones
Members should use mobile phones respectfully and avoid disrupting other users.
Phone conversations should be kept brief and away from training areas where possible.
16. Hygiene
Members must maintain a good standard of personal hygiene.
Anyone suffering from an infectious illness should not attend the Gym until no longer contagious.
17. Appropriate Clothing
Appropriate gym attire must be worn at ALL times - this includes keeping shoes and tops on.
Footwear must be clean and suitable for exercise.
Training without footwear may only be permitted in designated areas where authorised.
18. Personal Property
- Property is stored entirely at the owner’s risk.
- The Gym accepts no responsibility for loss, theft, or damage to personal belongings.
- Unclaimed items may be removed after a reasonable period.
19. Health & Safety
Members must:
- Follow all health and safety instructions.
- Report accidents immediately.
- Stop exercising if they feel unwell.
- Use spotters where appropriate.
- Respect emergency procedures.
20. Alcohol, Drugs & Smoking
Members must not:
- Attend under the influence of alcohol or illegal drugs.
- Smoke or vape inside the premises except where designated.
Anyone appearing intoxicated may be refused entry.
21. Prohibited Items
Weapons, illegal substances, hazardous materials, or any item that may endanger others are prohibited.
22. CCTV
CCTV operates throughout parts of the premises for security, safety, and crime prevention purposes.
23. Liability
While every reasonable effort is made to provide a safe environment:
- Members exercise at their own risk.
- The Gym shall not be liable for injury or loss resulting from misuse of equipment, failure to follow instructions, or circumstances beyond its reasonable control, except where liability cannot legally be excluded.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.
24. Damages
Members are responsible for damage caused through deliberate misuse or reckless behaviour.
Repair or replacement costs may be recovered.
25. Gym Closures
The Gym may occasionally close for:
- Maintenance.
- Equipment replacement.
- Cleaning.
- Emergencies.
- Events outside the Gym’s control.
Reasonable efforts will be made to minimise disruption.
26. Changes to Facilities
Equipment, classes, opening hours, and facilities may change from time to time without affecting the validity of membership.
27. Termination by the Gym
The Gym may suspend or terminate membership immediately for:
- Serious breach of these Terms.
- Aggressive or abusive behaviour.
- Criminal activity on the premises.
- Sharing membership access.
- Persistent non-payment.
- Behaviour that places others at risk.
Termination does not automatically remove liability for outstanding membership fees where legally enforceable.
28. Data Protection
Personal information will be collected, stored, and processed in accordance with applicable data protection legislation and the Gym’s Privacy Policy.
29. Changes to Terms
The Gym reserves the right to amend these Terms and Conditions where necessary. Members will be notified of significant changes.
30. Governing Law
These Terms and Conditions shall be governed by the laws applicable in the jurisdiction where the Gym operates.
Disclaimer
- Neither the gym nor the employees or agents of D&G Performance Gym shall be liable for any loss, damage or theft of personal property belonging to the member, or any guest of the member, occurring on the gym premises.
- Neither the gym nor the employees or the agents shall be responsible for any injury occurring upon the gym premises as a result of the misuse of the facilities and/or equipment provided by the gym.
- Members and guests who are in any doubt as to their physical fitness should seek medical advice before training.
